4. CANCELLATION

Nella Bella reserves the right, in its discretion, to limit quantities, terminate accounts and to refuse or cancel any order, including after the order has been submitted, whether or not the order has been confirmed and your credit card charged. In the event that your order is cancelled after your payment has been processed, Nella Bella will issue a full refund.

5. PRICE

All prices quoted are payable in Canadian Dollars. Although Nella Bella strives to provide accurate product and pricing information, errors may occur. Nella Bella reserves the right to correct any errors in pricing or product information and to modify the prices of Products, at any time, without prior notice. Nella Bella cannot confirm the price of a Product until after you submit an order for the Product. Without limiting the generality of Section 4 above, in the event that the price or related information for a Product (as described on the www.nella-bella.com website and/or the Order Confirmation) is incorrect due to an error in pricing or product information, Nella Bella may, at its sole discretion, refuse or cancel your order, whether before or after Nella Bella’s acceptance thereof. If there is such an error in pricing, Nella Bella will cancel your order and reverse any charges that have been applied, then contact you to ask you to place a new order for the Product at the correct price.

6. PAYMENT TERMS

Terms of payment shall be determined at Nella Bella’s sole discretion. Payment shall be made by credit card unless some other pre-arranged method of payment has been accepted by Nella Bella. Any payments made by credit card are subject to the approval of the financial institution that has issued the credit card.

7. PRODUCT AVAILABILITY

The availability of certain Products may be limited, and Products may not be available for immediate delivery. Nella Bella may revise or cease to make available any Products at any time without prior notice. In the event that Nella Bella is unable to deliver to you a Product ordered due to lack of availability, Nella Bella will notify you via e-mail and your order will be automatically cancelled with respect to such unavailable Product, provided that Nella Bella may, in its sole discretion, contact you in order to allow you to maintain your order subject to a revised delivery time if and when the Product becomes available.

8. SHIPPING; TAXES

Nella Bella will ship the Product(s) ordered by you according to the delivery method you have chosen and to the address indicated in the Order Confirmation. Nella Bella WILL ONLY SHIP PRODUCTS TO ADDRESSES LOCATED IN CANADA FOR PURCHASES MADE ON THE ONLINE STORE. Delivery times provided by Nella Bella are estimates only. Nella Bella shall not be responsible for any damages or costs resulting from any delays in delivery.

Unless otherwise stated, all prices quoted do not include shipping and handling charges and, when applicable, federal and provincial sales taxes. Separate charges for shipping and handling and taxes will be shown on the Order Confirmation for each Order, as applicable. You are responsible for all sales, use, goods and services, harmonized sales, and other taxes and duties associated with the Order.

9. OWNERSHIP; RISK OF LOSS

All Product(s) purchased from Nella Bella are delivered to you by a third party delivery company, pursuant to a shipping contract. You shall become the owner of the Product(s) and shall assume the risks of loss at the time of delivery by Nella Bella of the Product(s) to the third party delivery company.

10. RETURNS & EXCHANGE

All Product returns are subject to Nella Bella’s Return & Exchange Policy, the terms of which are incorporated herein by reference. Some restrictions may apply.

11. EXCLUSION OF WARRANTIES AND LIMITATION OF LIABILITY

Except as expressly provided for in this Agreement, Nella Bella does not make or give any representation, warranty or condition of any kind, whether express or implied, statutory or otherwise, including without limitation warranties as to uninterrupted or error free transactions, privacy, security, merchantability, quality, title, durability, suitability, non-infringement or fitness for a particular purposes, or those arising out of a course of dealing or usage of trade.

In no event will Nella Bella be liable for any indirect, incidental or consequential damages, howsoever caused, including but not limited to, any lost profits, lost savings, loss of use or lack of availability of facilities including computer resources, routers and stored data, punitive, exemplary, aggravated or economic damages, arising out of the products provided by Nella Bella or otherwise related to this Agreement or the transactions conducted on or from the www.nella-bella.com website, even if Nella Bella or any of their lawful agents, contractors, employees or mandataries have been advised of the possibility of such damages or claim. In no case will Nella Bella’s total liability arising under any cause whatsoever (including without limitation breach of contract, negligence, gross negligence or otherwise) be for more than the amount paid by you for the specific products ordered under this agreement and to which the claim relates. 12. GOVERNING LAW AND JURISDICTION

This website and its server are physically located within the Province of Ontario, Canada. This Agreement shall be construed and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein and shall be treated in all respects as an Ontario contract, without reference to principles of conflict of law. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

13. EXPORT LAWS

In the event that any provision of this Agreement is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.

18. ENTIRE AGREEMENT

This Agreement, together with all other agreements, terms or conditions incorporated or referred to herein constitute the entire agreement between you and Nella Bella relating to the subject matter hereof, the use of this website and any transactions conducted on or from this website, and supersede any prior understandings or agreements (whether electronic, oral or written) regarding the subject matter hereof, and may not be amended or modified except in writing, or by Nella Bella making such amendments or modifications available to it pursuant to this Agreement.

19. NO WAIVER

ORDER STATUS
You will see on-screen and receive via e-mail an order confirmation number after purchasing from the Nella Bella online store. Please use this confirmation number when you contact Nella Bella’s Customer Care.

If, after you receive your order, you find yourself with a bag you wish to return or exchange, please follow the steps outlined here:

RETURN/EXCHANGE PROCEDURE

1. Using your order number and full name as it appears on the original order, please email Nella Bella at info@nella-bella.com with your request for a return or exchange.

2. Once your initial order has been identified, you will be asked to select the item you wish to return or exchange and will be provided with a Return Authorization number (RA) and the return address. If it is an exchange please provide the details of the item you would like in exchange for the returned item.

3. Send the item(s) to the return address provided and please clearly indicate your RA number on the box being returned, otherwise it will be refused at the destination. Refunds and exchanges will only be issued once Nella Bella has received the returned item.

The Return or Exchange request must be received no longer than 15-days after you have received your merchandise (this period is determined based on the delivery date recorded by our delivery company).

** We will not accept any exchange or return requests received after the 15-day deadline.

** The item must be returned in their original condition, with all original tags attached, and free of any damage.

** Shipping charges for the returned/exchanged item(s) are the responsibility of the customer, as are the shipping charges for the new item(s) sent back to the customer in the event of an exchange.

REFUND POLICY

If all above conditions are properly met, Nella Bella will refund the price of the item(s) excluding shipping charges.

Will owning one of your handbags change my life?

Yes. If by changing your life you mean looking more chic and fashionable than ever before while carrying your Nella Bella handbag. If that’s not what you mean, then no, no it will not change your life. But you’ll probably be happier.

Does the Nella Bella online store ever have sales?

Online shopping at www.nella-bella.com was set up in order to serve our clients that don’t have easy access to a retailer that carries our bags, or clients who would like a specific color or style of handbag that retailers in their area don’t carry. Our website policy is to sell the current season always at full price. Older seasons may be on sale but for limited quantities and subject to availability.

Do you ship to where I live?

Nella Bella ships within Canada only. Unfortunately at this time, we do not ship to international addresses.

Can I modify my order after it has been placed online?

All we want is for you to be happy! So if you wish to modify or cancel your order, please email us at info@nella-bella.com as soon as possible so that we can try to accommodate your request before the order has been processed and shipped.

What is your return policy?

Returns and exchanges are accepted on merchandise within 15 days of receipt for items in their original condition that HAVE NOT BEEN USED, ALTERED OR DAMAGED and with ALL tags attached. The Return or Exchange procedure must be followed. PLEASE NOTE: Shipping charges are non-refundable.
